Zero Car Rental Privacy Policy

Summary

This policy explains what personal information Zero Car Rental Limited collects, why we collect it, who we share it with, how long we keep it, and your rights under the Privacy Act 2020. It is written to meet our obligations under that Act.

  • We collect only the information we need to hire you a vehicle safely and lawfully. Section 2 lists it.
  • We never see or hold your full card number. Stripe, our payment provider, holds a token. Before any charge after your rental, we notify you with supporting evidence and you have 24 hours to dispute it.
  • Some of our providers are based outside New Zealand, so some of your information is stored or processed overseas under comparable privacy protections or contractual safeguards. Section 7 names each provider.
  • We do not sell your information and we do not send marketing. You can ask to see the information we hold about you, ask us to correct it, or make a complaint at any time.

Zero Car Rental Limited collects and holds your personal information and is responsible for it under the Privacy Act 2020. Section 14 sets out how to contact us about your privacy or this policy.

2. What we collect

We collect the following personal information, depending on how you use our website and our services.

  • Who you are. Name, date of birth, address, phone number and email address.
  • Your driver licence. Licence number, type, country of issue, expiry date, photos of the licence, and the details we need to confirm you are entitled to drive in New Zealand. The same applies to any additional driver you add, including their licence photos.
  • Proof of address. A recent utility bill or bank statement, or the photo page of your passport if you live overseas.
  • Your booking. The vehicle, dates, pickup and return details, and the rental agreement you sign digitally at handover and again at return, including the vehicle condition record, photos and your signature.
  • Your payment. A token representing your card, held by Stripe, our payment provider. We do not hold your full card number. Section 5 sets this out.
  • An emergency contact. The name and phone number of the person to contact in an emergency during your hire.
  • Accident details. Where an accident occurs during your hire, the details of the other party that you give us, photos of the scene, and any incident report. Our terms and conditions set out what you need to collect.
  • Your contact with us. Messages, emails, WhatsApp conversations and call notes.
  • Signing in. When you sign in to manage your booking, we email you a one-time code.
  • Technical data. Your IP address, approximate location, and how you use our website, used to keep the website secure and to improve it. Section 8 sets out cookies and analytics.

Your licence details, licence photos and proof of address are a condition of hire. If you do not provide them, we cannot hire you a vehicle. The emergency contact is optional.

3. Why we collect it

We use your personal information to:

  • take and manage your booking, and hire you a vehicle
  • confirm that you and every additional driver are eligible and legally entitled to drive
  • take payment, and charge the amounts you have authorised in your rental agreement, such as the excess after an at-fault incident or the fuel charge where the vehicle is returned with less than a full tank
  • manage incidents, accidents, fines, tolls and insurance claims
  • meet our legal obligations
  • contact you about your booking and your hire
  • keep our website secure
  • improve our website and our service.

We do not send marketing. We use your emergency contact's details only to reach that person in an emergency during your hire, and never for any other purpose.

4. How we collect it

We collect most personal information directly from you, when you book, message us, sign in to manage your booking, or sign your rental agreement. Some technical data is collected automatically when you use our website, as set out in section 8.

Additional drivers. When you add another driver, you give us their personal information. By doing so you confirm that you have their permission, and you agree to tell them that you have shared their details with us and why. The same applies to the emergency contact you give us. We treat their information in the same way as yours.

We may also collect information from third parties you have authorised, or where the Privacy Act allows.

5. Your card and payment details

Payment is processed by Stripe, our payment provider, which is certified to the PCI DSS security standard. Stripe holds a token that lets us charge your card for the amounts you have authorised in your rental agreement. We never hold your full card number on our own systems. Before we process any charge after your rental, we notify you by email or WhatsApp with supporting evidence, and you have 24 hours to dispute the charge.

6. Who we share it with

We do not sell your personal information. We share it only where it is needed to provide our service or to meet the law.

  • Stripe, our payment provider, to process your payment and any authorised post-rental charge.
  • Our insurer, where we need to manage an accident or insurance claim involving your hire.
  • Service providers who help us run our business, such as website hosting, analytics and email, under obligations to protect your information.
  • Authorities, including NZ Police, NZ Transport Agency and local councils, where the law requires it, for example to transfer a traffic infringement into your name, and to report a vehicle that has not been returned.
  • A debt collection agency or legal advisers, only where an authorised amount you have not paid is referred for recovery.

7. Sending information overseas

Some of the providers we use to run our website, payments and messaging are based outside New Zealand:

  • Stripe, for payment processing
  • Cloudflare, for website hosting, security, analytics and email
  • Google, for address lookup
  • Meta, for WhatsApp messaging.

These providers are located in countries including the United States, Ireland and Australia. This means some of your personal information is stored or processed overseas.

We use only providers that are subject to privacy protections comparable to New Zealand's, or that are bound by contractual safeguards to protect your information to the standard the Privacy Act requires.

8. Cookies and analytics

Our website uses cookies and similar tools to work properly and to understand how the site is used.

  • Essential cookies keep the site and your booking working, including keeping you signed in when you manage your booking.
  • Analytics. We measure how the site is used through Cloudflare Web Analytics, which does not use cookies and does not identify you.

We do not use advertising trackers. You can clear cookies through your browser at any time.

9. Keeping your information safe

We protect personal information with security safeguards that are reasonable in the circumstances, as the Privacy Act requires. Information is encrypted in transit and at rest. Access to your personal information is limited to staff who need it for their work, and access to identity documents is logged. We do not hold full card numbers on our own systems.

If a privacy breach occurs and it is likely to cause you serious harm, we notify you and the Office of the Privacy Commissioner, as the Privacy Act requires, and tell you what we are doing about it.

10. How long we keep it

We keep personal information only for as long as we need it to provide your hire, to meet our legal, tax and insurance obligations, and to resolve any charge, claim or dispute that arises afterwards.

  • Licence and address documents, and handover and return photos. Kept for up to 6 months after the vehicle is returned, or until any related charge or dispute is resolved, whichever is later.
  • Photos and documents from a booking you did not finish. Deleted after 24 hours.
  • Booking records, signed agreements, receipts and invoices. Kept for 7 years, to meet our business record obligations.
  • Our correspondence with you. Kept for 2 years.

When we no longer need information, we dispose of it securely.

11. Your rights

Under the Privacy Act 2020, you have the right to ask for the personal information we hold about you, and to ask us to correct it if it is wrong. If we do not make a correction you ask for, you can ask us to attach a note of the correction you requested to the information. We respond within the time the Act allows. Section 14 sets out how to contact us.

If you are not satisfied with how we have handled your personal information, you can complain to the Office of the Privacy Commissioner at www.privacy.org.nz.

12. Children

Our services are for holders of a full driver licence and are not directed at children. We do not knowingly collect personal information from anyone under 16. If you believe a child has given us their personal information, contact us and we will remove it.

13. Changes to this policy

We may update this policy from time to time. The current version is always at www.zerocarrental.co.nz/privacy. The "last updated" date at the top shows when it last changed.
