1.Agreement and parties

1.1These terms and conditions govern your use of the Zero Car Rental website and the hire of any vehicle from Zero Car Rental Limited, a company registered in New Zealand ("Zero Car Rental", "Zero", "we", "us", "our"). "You" means the person making the booking and hiring the vehicle.

1.2By making a booking you agree to these terms. At handover you sign a rental agreement recording your details, the vehicle, its condition, and the charges you authorise. The signed rental agreement and these terms together form the contract for your hire. If they differ, the signed rental agreement applies to that rental.

1.3We may update these terms from time to time. The version published on our website at the time of booking applies to your booking.

2.Bookings

2.1Bookings must be made no later than the day before pickup. Same-day bookings are not available.

2.2All bookings are subject to availability and acceptance. We confirm bookings by email or message. We may decline or cancel a booking where reasonably necessary, for example where a vehicle becomes unavailable or eligibility requirements cannot be met. If we cancel your booking, you receive a full refund.

2.3At the time of booking you provide licence details and photos for every driver (clause 6), one supporting proof of address, and full payment (clause 4).

2.4Your booking is for a specific vehicle. If that vehicle becomes unavailable before pickup, we will supply a comparable or better vehicle at no additional cost, or refund your booking in full if you prefer.

3.Rates and inclusions

3.1All rental rates include GST, comprehensive vehicle insurance, unlimited kilometres within New Zealand, and roadside assistance.

3.2We do not charge booking fees, card surcharges, premium location fees, airport fees, or any other additional fees. The total displayed at booking is the full and final amount payable, subject only to the charges in clause 10 where the corresponding event occurs.

4.Payment

4.1Payment is by card through our website at the time of booking. The rental is paid in full at booking. No other payment method is offered.

4.2No deposit, bond, or pre-authorisation hold is ever placed against your card.

4.3Card details are stored securely by Stripe, our payment provider, which is certified to the PCI DSS security standard. We do not hold your full card number on our own systems.

4.4Your card is charged after your rental only if an event listed in clause 10 occurs. Before processing any charge, we notify you by email or WhatsApp with supporting evidence, such as inspection photos, repair invoices, or infringement notices, and you have 24 hours to dispute the charge.

4.5By signing the rental agreement, you confirm that you are the cardholder or have the cardholder's authority, and you authorise us to charge the card for the amounts in clause 10 where they apply.

5.Cancellations, changes and extensions

5.1You can cancel or change a booking by contacting us or through the booking management link in your confirmation.

5.2Cancellations made more than 24 hours before pickup receive a full refund.

5.3Cancellations made within 24 hours of pickup, and no-shows, incur a cancellation fee of 15% of the total rental cost. The balance is refunded.

5.4Changes to a booking are accommodated where availability allows.

5.5Extension requests should be made at least 48 hours before the scheduled return time. Extensions are subject to availability, and we may decline a request where the vehicle is committed to another booking. Requests made with less notice will be considered where possible.

5.6An approved extension is charged at the rate current at the time of the extension and paid by card before the extension begins. The only way to keep the vehicle beyond the agreed return time without the late return charges in clause 7.4 is to request an extension before that time and have it approved.

6.Driver eligibility

6.1Every driver must hold a full New Zealand or full overseas driver licence. Learner, restricted, and provisional licences are not accepted.

6.2Overseas licences must be in English or accompanied by an official translation from an NZTA-approved translator.

6.3Every driver must be named on the rental agreement, and we sight each driver's physical licence at handover. Only named drivers may drive the vehicle.

7.Collection and return

7.1Vehicles are handed over and collected at one of three fixed points: Auckland International Airport, Auckland Domestic Terminal, or our Safe Store Westgate depot.

7.2At handover, we record the vehicle's condition, including photos, on the rental agreement, and you confirm the record. The same inspection is completed at return. We encourage you to take your own photos at both points.

7.3The vehicle must be returned at the agreed time, in reasonable condition allowing for fair wear and tear, with a full tank and its key. A reasonable grace period applies on the day.

7.4Keeping the vehicle beyond the agreed return time without an approved extension is a late return, charged under clause 10. Extensions are set out in clause 5. Clause 7.5 may also apply.

7.5If the vehicle is not returned within 24 hours of the agreed return time and we cannot reach you, we may report the vehicle to NZ Police as unlawfully taken and recover it. Recovery costs are charged under clause 10.

7.6No refund is payable for an early return. The rental price covers the booked period.

7.7A copy of the signed rental agreement must be kept in the vehicle throughout the hire and produced on demand to an enforcement officer, as required under New Zealand rental service law.

8.Use of the vehicle

8.1The vehicle is for personal use by named drivers only. The vehicle must not be:

  • driven under the influence of alcohol or drugs, or over the legal limit
  • used for racing, speed tests, or any unlawful purpose
  • used for rideshare, or to carry passengers or goods for hire or reward, including any passenger service requiring a licence under Part 4A of the Land Transport Act 1998
  • driven off sealed, maintained public roads, on beaches, or through fords or floodwaters, without our written consent
  • loaded beyond the manufacturer's specifications, or driven in an unsafe condition
  • filled with the wrong fuel type
  • smoked or vaped in
  • taken into areas restricted under New Zealand biosecurity rules.

8.2You must keep the keys secure and comply with all New Zealand road rules, including speed limits, mobile phone rules, and driving on the left. Visitors from overseas should read NZ Transport Agency guidance before driving.

8.3If the vehicle is used in serious breach of these terms, we may terminate the hire and recover the vehicle. Recovery costs are charged under clause 10, and no refund is payable for the unused portion of the hire. Clause 9.5 sets out when insurance cover is void.

9.Insurance and excess

9.1Every rental includes comprehensive vehicle insurance with a licensed New Zealand insurer. An excess applies per incident where you are at fault.

9.2The standard excess is NZD 800 to 1,500 per incident, depending on the vehicle. The excess applying to your hire is shown on your rental agreement.

9.3The excess is waived in full where you are confirmed not at fault and you provide the at-fault party's complete details: their full name, phone number, address, licence, vehicle registration, and insurer. Clause 11.4 sets out what to do at the scene.

9.4An additional excess applies where an at-fault incident occurs and the driver at the time is one of the following. It does not change the rental price and applies only to the excess payable after an at-fault incident.

  • under 21 years of age: an additional NZD 1,000
  • aged 21 to 24: an additional NZD 500
  • aged 25 or over and holding a full NZ licence for less than 12 months: an additional NZD 500.

9.5Insurance cover is void, and you are liable for the full market value of the vehicle plus recovery and third party costs, where an incident occurs while the vehicle is being driven:

  • under the influence of alcohol or drugs, over the legal limit, or after refusal of a lawful blood or breath test
  • by a person who leaves the scene of an accident contrary to law
  • by an unauthorised driver, or a driver without the correct licence class or in breach of licence conditions
  • in racing, speed tests, or any intentional, reckless, or illegal act
  • in a known unsafe condition, or overloaded beyond the manufacturer's specification
  • with the wrong or contaminated fuel
  • off sealed, maintained public roads without our written consent.

10.Additional charges, tolls and infringements

10.1The following charges apply only where the corresponding event occurs during your hire. Each charge is notified with supporting evidence under clause 4.4 before it is processed.

  • Insurance excess. An at-fault incident occurs, as set out in clause 9. Amount: NZD 800 to 1,500 per incident, as shown on your rental agreement
  • Fuel. The vehicle is returned with less than a full tank. Amount: NZD 100
  • Key replacement. A vehicle key is lost, damaged, or stolen during the hire. Amount: NZD 500
  • Fines, tolls and infringements. A traffic or parking fine, speeding penalty, or toll is incurred during the hire, as set out in clauses 10.2 and 10.3. Amount: The actual amount, plus a reasonable processing fee
  • Cleaning. The interior is returned in a badly soiled or damaged state, including from smoking or pet damage. Amount: The actual cleaning cost
  • Recovery. The vehicle requires recovery following prohibited use under clause 8. Amount: The actual recovery cost
  • Late return. The vehicle is returned late without an approved extension, as set out in clause 7.4. Amount: One additional day at the daily rate for each 24-hour period, or part of one, past the agreed return time, plus a NZD 75 late return fee. If the vehicle was required for another confirmed booking, you are also liable for our reasonable costs of arranging a replacement vehicle for that booking

10.2Some New Zealand roads are tolled, including the Northern Gateway Toll Road and the Tauranga Eastern Link, and vehicles can pass through without stopping. You are responsible for all tolls, parking charges, traffic infringements, and freedom camping infringements incurred during your hire.

10.3Where we receive an infringement or toll notice, we will transfer it into your name where possible, or charge the actual amount to your card plus a reasonable processing fee under clause 10.1. Infringements issued by NZ Police, NZ Transport Agency, or local councils may be processed after your rental ends.

10.4If an amount properly charged under these terms cannot be collected, for example where the stored card is declined and the amount remains unpaid after we have notified you and given you a reasonable opportunity to pay, we may refer the outstanding balance to a debt collection agency. You are liable for the outstanding amount together with all reasonable costs of recovery, including debt collection agency fees and legal costs, which may be added to the debt.

11.Accidents and breakdowns

11.1If you require roadside assistance, contact us first on +64 800 800 521.

11.2If a warning light illuminates or the vehicle appears to require mechanical attention, stop driving as soon as it is safe to do so and contact us before continuing.

11.3If the vehicle becomes unusable through a fault not caused by you, we will supply a replacement vehicle where one is available, or refund the unused portion of the hire.

11.4In the event of an accident, you must:

  1. contact us immediately
  2. collect the other party's complete details, as listed in clause 9.3. These details are required for the excess waiver
  3. photograph the scene and all vehicles involved, where it is safe to do so
  4. not arrange repairs without our authorisation
  5. complete any incident report we require.

12.Consumer guarantees and liability

12.1Nothing in these terms limits or excludes any right you have under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986. Where a vehicle or service is acquired for business purposes, the Consumer Guarantees Act may not apply to the extent the law allows.

12.2To the extent the law allows, we are not liable for indirect or consequential losses arising from your hire or from use of our website, and we do not warrant that the website will be uninterrupted or error-free. This does not affect your rights under the Consumer Guarantees Act, or our responsibility for death or personal injury caused by our negligence, or for fraud.

12.3You agree to indemnify us against losses or claims, to the extent they are caused by your misuse of a vehicle or the website, or your breach of these terms.

13.Events beyond our control

13.1We are not responsible for delays or cancellations caused by events beyond our reasonable control, including severe weather, earthquakes or volcanic activity, road closures, government restrictions, fuel shortages, or emergencies.

14.Website use

14.1Our website and app, and their content, belong to Zero Car Rental or our licensors. They are for personal, non-commercial use. You must not copy, scrape, resell, or interfere with them, or attempt to access systems you are not authorised to access.

14.2We may use any feedback you provide to improve our service. Our website may link to third party websites, and we are not responsible for their content or privacy practices.

15.Privacy

15.1Our handling of personal information is set out in our Privacy Policy at www.zerocarrental.co.nz/privacy. By booking, you agree to that policy.

16.General

16.1These terms are governed by New Zealand law, and the New Zealand courts have jurisdiction.

16.2If any part of these terms cannot be enforced, the remainder still applies. Headings are for convenience only.

16.3Together with your signed rental agreement, these terms are the entire agreement between us regarding your hire.
